THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT APPEAL NO.617 OF 2018 AND WRIT PETITION NO.8983 OF 2018 COMMON JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} This appeal is preferred against the order passed by the learned Single Judge in WP.No.8983 of 2018 dated 02.04.2018. The appellant herein filed the Writ Petition to declare the action of the Commissioner, GHMC, in giving permission to the third and fourth respondents for construction of a building at Plot Nos.188 and 195 admeasuring 800 square yards in Survey No.62 part, Uppal Mandal, Swaroopnagar, Ranga Reddy District, as arbitrary and illegal. By the order under appeal dated 02.04.

2018, the learned Single Judge dismissed the Writ Petition holding that the petitioner had already approached the Civil Court. After arguing for some time, Sri A.Satya Prasad, learned Senior Counsel appearing for the appellant, would submit that, instead of adjudicating the appeal on its merits, the appellant may be permitted to withdraw the Writ Petition itself. Sri Pasham Krishna Reddy, learned Standing Counsel for the GHMC, expresses 'no objection' for the appellant-writ petitioner to withdraw the Writ Petition.

Since the Writ Petition was dismissed at the stage of admission, and as Sri A.Satya Prasad, learned Senior Counsel, seeks permission to withdraw the Writ Petition, the order under appeal is set aside, the Writ Petition is restored to file, and is

dismissed as withdrawn. The Writ Appeal is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
