HON'BLE SRI JUSTICE S.V.BHATT W.P.No.16291 OF 2017 ORDER:

The petitioner claims to have established and also operating a brick kiln in Sy.No.47/ 3C at Narsaraopet Road, Phirangipuram, Houseganesh, Guntur and apprehending interference into the day-to-day activities of petitioner pursuant to complaint dated 17.03.2017, the present writ petition has been filed. One of the grounds raised by petitioner is that respondents without enquiring into the matter and/ or passing order against petitioner are physically interfering with day-to-day activities of petitioner.

On 28.04.2017, this Court granted interim direction restraining respondent No.3 from interfering with the day-to-day activities of petitioner.

Prima facie, this Court is of the view that the writ has been filed on apprehension that the 3rd respondent pursuant to complaint dated 17.03.2017 will interfere with the day-to-day activities of petitioner. If the complaint against the petitioner is received, it is for respondent No.3 to examine the nuisance complained against the petitioner and take action in accordance with law. At this stage, this Court does not want to advise the 3rd respondent as to what he should do in the matter or grant blanket order in favour of the petitioner.

To meet the ends of justice, the writ petition is disposed of by this order:

(i) the interim order granted by this Court on 28.04.2017 is directed to be continued for a period of four weeks from today; and (ii) respondent Nos.3 and 4 are directed to look into the grievance of villagers on air pollution emanating from the brick kiln of petitioner and pass orders within four weeks from today.

There shall be no order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed. _____________ S. V. BHATT, J 26th April, 2018 Note:
