THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41048 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in registering the FIR No.177 of 2016, as illegal and arbitrary and to consequently set aside the FIR No.177 of 2016.
The grievance of the petitioners is that the 1st petitioner is the elder sister of A-1 and the 2nd petitioner is the husband of the 1st petitioner. The grievance of the petitioners is that the 3rd respondent marriage A-1 on 31.10.2015 and at the time of marriage, the parents of the 3rd respondent spent an amount of Rs.6,70,000/- for marriage expenses and gave Rs.5,00,000/- cash and Rs.4,00,000/- worth gold to A-1 and his family and that after marriage, A-1 and his family members are harassing the 3rd respondent and cheating her by hiding the impotency of her husband. Based on the said complaint, the 2nd respondent registered the same as FIR No.177 of 2016 and the 2nd respondent, under the pressure of the 3rd respondent, is threatening the petitioners to arrest.
Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in FIR No.177 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 25th November, 2016 KL
