THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.39997 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

This common Writ Petition is filed on behalf of ten petitioners by contending that each one of them have made applications under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act') seeking grant of pattadar pass books and title deeds. The grievance of the petitioners is that though they have made applications on various dates and requisite fee was paid in Mee Seva, no action is taken by the Tahsildar, Utkuru Mandal, Mahabubnagar District, the 3rd respondent.

When this Writ Petition came up yesterday, it was noticed that when ten different petitioners have made ten different applications on different dates for grant of pattadar pass books, they cannot seek a common relief for all of them seeking pattadar pass books for each one of them.

The relief sought for being not a common relief and is confined to the individual relief basing upon the inaction of the 3rd respondent in considering the respective applications, the petitioners ought to have filed separate Writ Petitions instead of the present common Writ petition and therefore requested learned counsel for the petitioners to examine the matter and apprise the Court about the aforesaid view, which is already taken by this Court in earlier matter and the Writ Petition was confined to one of the petitioners giving liberty to the learned counsel for the petitioners to file separate Writ Petitions with regard to other petitioners.

The said request is accordingly acceded to and the order in this Writ Petition shall be confined to the 1st petitioner and the Writ Petition is dismissed so far as the petitioners 2 to 10 are concerned with liberty to each one of them to file separate Writ Petitions.

Since the 1st petitioner has made application under Form VI-A of the Act before the recording authority, namely, the Tahsildar and paid the requisite fee in Mee Seva on 27.05.2015, the 3rd respondent is directed to consider the said application of the 1st petitioner in accordance with law and pass appropriate orders expeditiously preferably within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
