This Writ Petition is filed for a Mandamus to restrain respondent Nos.1 and from giving effect to T.O.O.RT.No.380, dated 14-12-2006, and to set aside the same.
At the hearing, Mr.S.Ravindranath, learned Counsel for the petitioner, submitted that during the pendency of this Writ Petition, his client has retired on attaining the age of superannuation. He has further submitted that in pursuance of the interim direction issued by this Court on 20-12-2006, the respondents have issued Memo No.CGM (HRD & Trg)/DS(P)/AS(P)/PO-III-2/1234/2006, dated 25-01-2007, whereby the petitioner's representation for promotion as Personnel Officer was rejected as she has not completed the required service of ten years since she was on EOL for more than two years and that her case will be considered as and when she completes ten years of her service as JPO. The learned Counsel for the petitioner, however, submitted that inasmuch as her client is not in service and Memo, dated 25.01.
2007, passed during the pendency of the Writ Petition has not been specifically questioned in this Writ Petition, the Writ Petition may be closed with liberty to his client to avail a fresh remedy to question the above-mentioned Memo. Having regard to the above submisison of the learned Counsel for the petitioner, the Writ Petition is disposed of without expressing any opinion on the merits of the case and with liberty to the petitioner in terms of the prayer made. As a sequel to disposal of the Writ Petition, WVMP.No.4412 of 2011 in/& WPMP.No.33942 of 2006 are disposed of as infructuous.
