Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The petitioner was inducted as a sub-tenant, in respect of Dargah Hzt. Sarda Baig Saheb Qibla (Rh), Aghapura, Hyderabad, situated at premises No.11-4-437, and is being managed by the mutawalli. The petitioner states that he has been running mirchi fry shop thereat for the last two years, and has been paying rents regularly. While so, the fourth respondent came to the subject premises on 28.05.2015, forcibly seized the material lying thereat and locked the subject premises.
In spite of several representations, lock was not opened, and the key was not given to the petitioner. Hence the Writ Petition.
This Court granted time to the learned Standing Counsel for the respondents to instruct the officer concerned to handover the key but, till today, no action has been taken. In the absence of any counter affidavit objecting to the plea of the petitioner, this Court is inclined to allow the Writ Petition directing respondent Nos.2 to 4 to handover the key in respect of premises No.11-4-437, Aghapura, Hyderabad within a period of two days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
