THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.7692 of 2003 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed by the respondent in O.A.No.11345 of 2002 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, which was disposed of by order dated 19.12.2002. By the said order, the Tribunal directed the petitioner herein to follow the procedure observed in the decision of the Supreme Court in 1996 (6) SCALE 676 while making recruitment to the post of Sweeper and if the first respondent-applicant made an application prior to commencement of the selection process, her case also was directed to be considered along with other candidates, including those sponsored by the employment exchange, if she was otherwise eligible and qualified for the post.
Despite service of notice, the first respondentapplicant did not choose to enter appearance before this Court either in person or through learned counsel. Heard Sri B. Thimothi, learned counsel for the petitioner. This writ petition was admitted as long back as on 29.04.2003 and no interim order was granted insofar as the direction of the Tribunal was concerned.
In that view of the matter, the issue, in our opinion, has become stale and as the first respondent-applicant did not even choose to come before this Court, no adjudication is required on merits at this stage.
The writ petition is accordingly dismissed as infructuous. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
