HON'BLE SRI JUSTICE S.V.BHATT W.P.No.1326 OF 2009 ORDER:

The Depot Manager, A.P.S.R.T.C is the writ petitioner. The petitioner challenges the award dated 27.06.2007 in I.D.No.50 of 2005 on the file of the Industrial Tribunal-cum- Labour Court, Anantapur. Through the award dated 27.06.2007, the Labour Court, while setting aside the order of removal, directed reinstatement of 1st respondent/workman with continuity of service but without attendant benefits and backwages.

On 11.12.2012, on the request of learned counsel appearing for the petitioner, this Court granted three weeks time to take steps to bring on record the legal representatives of the deceased workman with a default clause. From the docket proceedings, it appears that as no steps for bringing on record the legal representatives of deceased workman were taken by the petitioner, the writ petition stood abated against the 1st respondent. Taking note of abatement of the writ petition against the 1st respondent, the writ petition is dismissed as the award has become final against the 1st respondent. The petitioner, however, is given liberty, if so advised, to file petitions, in accordance with law, for bringing on record the legal representatives of deceased workman and for setting aside the default clause etc. There shall be no order as to costs.

Consequently, interim order granted by this Court on 30.01.2009 is vacated, and miscellaneous petitions, if any, pending in the writ petition shall stand dismissed.
