HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15360 of 2019 ORDER :
This writ petition is filed seeking Mandamus to declare the action of the respondents in not implementing the common order dt.03.06.2016 in O.A.No.9183 of 2011 passed by the A.P. Administrative Tribunal, Hyderabad, as illegal and arbitrary, and consequently, sought a direction to the respondents to implement the said orders.
Heard Sri K. Ram Reddy, learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents.
Learned counsel for the petitioner contends that though the order dt.03.06.2016 in O.A.No.9183 of 2011 passed by the Tribunal has become final, inspite of repeated requests and representations made by the petitioner, the respondents are not implementing the said order. The learned counsel, therefore, contends that appropriate orders be passed in the writ petition directing the respondents to implement the said order dt.03.06.2016 in O.A.No.9183 of 2011 passed by the Tribunal, within a stipulated period of time.
AKS, J W.P.No.15360 of 2019 The learned Government Pleader for Revenue contends that if the petitioner submits a fresh representation seeking implementation of the order dt.03.06.2016 in O.A.No.9183 of 2011 passed by the Tribunal, the respondents would consider the same and pass appropriate orders in accordance with law. This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation within a period of two weeks from the date of receipt of a copy of this order seeking implementation of the order dt.03.06.2016 in O.A.No.9183 of 2011 passed by the Tribunal.
Upon receipt of such a representation from the petitioner, the respondents shall consider the same and pass appropriate orders in accordance with law, within a period of eight weeks thereafter. With the above observation and direction, this writ petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
