O R D E R :
This writ petition is filed seeking mandamus to declare the inaction of the respondents 4 to 6 in not taking any action upon the complaint of the first petitioner dated 29/3/2018 and not extending protection to the petitioner No.2 and further threatening the second petitioner to flee away from the village for two or three months by the sixth respondent, as illegal, arbitrary and violative of Article 14, 16, 21 and 300-A of the Constitution of India and violation of Section 4, 6 and 7 of Protection of Civil Rights Act, 1955 and consequently to direct the sixth respondent to register a crime on the basis of the complaint of the first petitioner dated 29/3/2018 forth with and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home [AP] appearing for the respondents.
3. The learned Assistant Government Pleader for Home submitted written instructions filed by the Sub-Inspector of Police, Ramakrishnapur Police Station, Mancherial district, stating that Police never received the complaint but the learned counsel for the petitioner has produced a copy of the registered post endorsement as "refused". It is not known how the Police can refuse registered post, this cannot be appreciated.
4. In view of the same, the sixth respondent is directed to receive the complaint, which was sent earlier by registered post with acknowledgement due and take necessary action on the complaint in accordance with law, as per the principles laid down in the judgment of the Hon'ble Supreme Court in LALITHA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH reported in [ 2014 ] 2 SCC-1.
5. With the above direction, this writ petition is disposed of at the admission stage.
5. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand disposed of. No costs. _____________________________ JUSTICE A. RAJASHEKAR REDDY.
