HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.29490 of 2017 ORDER ::

When the matter is taken up for hearing, learned Standing Counsel for the respondent‐Life Insurance Corporation of India submitted that the petitioners seeking for the self same relief, as the one sought in this writ petition, filed writ petition being WP No.17230 of 2013 and this Court passed interim orders in WPMP No.20929 of 2013 and, therefore, this writ petition is not maintainable.

2. Learned counsel for the petitioner does not dispute this submission made by the learned counsel for the respondents, but submitted that the respondents have not complied with the interim orders passed by this Court in the above WPMP and, therefore, petitioners filed this writ petition.

3. A perusal of the order passed in WPMP No.20929 of 2013 in WP No.17230 of 2013, it is evident that the respondents therein were directed not to replace the petitioners with any temporary employees recruited afresh.

If the petitioners, who are parties to the earlier writ petition, WP No.17230 of 2013, feel that the order of this Court has not been complied with, they have a remedy, but they cannot be permitted to file one more writ petition for the self same relief. If the interim order passed in the earlier writ petition is subsisting, the respondents are obligated to comply the same.

5. In the circumstances, the writ petition cannot be entertained and it is accordingly dismissed. Miscellaneous petitions, if any pending in this case shall also stand dismissed. There shall be no order as to costs. ________________________ A. RAJASHEKER REDDY, J Dated: 01‐09‐2017 NRG
