This transfer petition is filed to withdraw AS.No.13/2014 pending on the file of IX Additional District Judge, Wanaparthy and to transfer the same to this Court to be heard along with connected LAAS.No.368/2014 which is pending on the file of this Court. The case of the petitioner is that OS.No.15 of 2007 filed by the 1st responden herein on the file of Senior Civil Judge, Nagarkurnool for partition and LAOP No.52 of 2007 which was referred under Section 30 of the Land Acquisition Act, were disposed of on 02.06.2014 by the Senior Civil Judge, Nagarkurnool by way of separate Judgments. Aggrieved by the orders in LAOP No.52/2007 and OS.No.15 of 2007, the petitioner herein filed LAAS No.368 of 2014 on the file of this Court and AS.No.13/2014 on the file of IX Additional District Judge, Wanaparthy, respectively and the same are pending.

The grievance of the petitioner is that since the property, parties and question of fact and law involved in both the above referred cases is one and the same, AS.No.13/2014 should be transferred to the file of this Court to be tried along with LAAS No.368/2014.

Heard both sides.

Counsel appearing for both the parties expressed 'no objection' for withdrawing AS.No.13 of 2014 pending on the file of IX Additional District Judge, Wanaparthy and transferring the same to the file of this Court to be tried along with LAAS No.368 of 2014.

In view of the above, the Transfer petition is allowed. The AS.No.13 of 2014 pending on the file of IX Additional District Judge, Wanaparthy is withdrawn and transferred to this Court to be tried along with LAAS No.368 of 2014. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending shall stand closed.
