HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.46483 of 2016 Order:
This Writ Petition is filed challenging the registration of Crime No.339 of 2016 on 17.10.2016 by the third respondent based on the complaint lodged by the fourth respondent.
This Court, by order dated 30.12.2016, granted stay of all further proceedings and the said order was modified by a subsequent order dated 13.03.2017 giving liberty to the respondents 2 and 3 to continue the investigation pursuant to registration of Crime No.339 of 2016, but shall not arrest the petitioner until further orders. Now, a counter affidavit is filed by the respondents. The petitioner is the sole accused in the FIR. It appears that during the investigation the investigating officer examined the complainant and some other witnesses, but in view of the interim orders passed earlier on 30.12.2016 the investigation could not be proceeded. In view of the subsequent order passed by this Court on 13.03.2017, this Writ Petition is disposed of giving liberty to the respondents 2 and 3 to continue the investigation pursuant to registration of Crime No.339 of 2016 without arresting the petitioner. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
