THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18507 OF 2017 ORDER :

This writ petition is filed seeking a writ of Mandamus to declare the action of the respondent No.2 in issuing the proceedings No.P2/255(02)/2017-YMG, dated 05.05.2017 as illegal and arbitrary. A consequential direction is sought to set aside the same.

Heard Sri K.V.Raghuveer, learned counsel for the petitioner and Sri Aravala Rama Rao, Standing Counsel for the respondents.

It is the case of the petitioner that he was placed under suspension vide proceedings No.P2/255(02)/2017-YMG, dated 5.5.2017 on the ground that he had produced a false caste certificate. The said caste certificate was cancelled by the incompetent authority i.e., Mandal Revenue Officer.

Challenging the same, the petitioner had filed W.P.No. 19490 of 2017 and this Hon'ble Court suspended the impugned orders vide orders dated 11.7.2017 in W.P.M.P.No.23742 of 2017 in the said writ petition.

It is submitted by learned counsel for the petitioner that the competent authority to cancel the caste certificate is District Collector as per Andhra Pradesh (SC,ST&BCs) Regulation of Issue of Community Certificates Act, 1993 and the action of the respondent-Corporation in placing the petitioner under suspension is arbitrary and illegal. Learned Standing Counsel for the respondentCorporation today produced the proceedings No.E1/255(1)/ 2017-RM-Q, dated 30.11.2017 wherein the suspension orders were recalled and the petitioner was given posting at Adoni Depot.

In view of the same, as the suspension orders have been revoked by the respondent-Corporation, the cause in the writ petition does not survive.

This writ petition is dismissed as no further orders are necessary. No order as to costs.

Consequently, pending miscellaneous petitions, if any, in the writ petition shall stand closed.
