Sri Venkata Lakshmi Poultry Farms v. State Of Andhra Pradesh
HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6449 OF 2015 ORDER:
This Criminal Petition is filed by the petitioners under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.238 of 2014 on the file of Judicial First Class Magistrate, Nidadavolu, where the learned Magistrate has taken cognizance for the offence punishable under Sections 138 and 142 of the Negotiable Instruments Act..
Heard the learned counsel for the petitioners and the learned Public Prosecutor (A.P.) for the State before notice to respondent No.2 and before admission. Perused the material on record.
As the material falls short for this Court to admit the application under Section 482 Cr.P.C., this application is disposed of giving liberty to the petitioners to file an application under Section 258 Cr.P.C. if no grounds to frame charge. Needless to say in the event of framing of any charge from any of the penal sections, then remedy is left open to the petitioners. Needless to say, if any application is filed to represent one accused on behalf of other accused under Rule 37 of Criminal Rules of Practice, the learned Magistrate shall hear and permit with necessary conditions.
Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed. _________________________ Dr. B. SIVA SANKARA RAO, J
