HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.133 of 2016 ORDER:

This petition is filed to withdraw O.P.No.108 of 2014 from the file of Family court, Ongole and transfer the same to Family Court, Hyderabad.

2. Wife filed this petition. According to her affidavit her marriage with respondent was performed on 20.05.2009 at Satyanarayana Swamy temple at Annavaram, East Godavari District, as per Hindu rites and custom and respondent was not having any job at the time of marriage and a male child was born during their wedlock named as Mokshagyna. She stated that due to disputes she is forced to stay at her parents' house in Hyderabad and stated that respondent filed O.P.No.108 of 2014 before Family court, Ongole and she is facing difficulty to attend the Court at Ongole for each and every adjournment. She stated that for the sake of convenience and her safety, OP pending before Family Court, Ongole has to be transferred to Family court, Hyderabad.

3. This court permitted petitioner to take out personal notice to respondent through registered post with acknowledgment due and file proof of service. In compliance of the said order, advocate for petitioner filed Memo before this court on 06.04.2016 stating that notice sent to respondent was served and along with Memo postal acknowledgment is filed. In spite of service of notice respondent neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.108 of 2014 is withdrawn from the file of Family court, Ongole and transferred to Family Court, Hyderabad for disposal in accordance with law.

6. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed. __________________ S. RAVI KUMAR, J Date: 11-04-2016 gvl
