This writ petition is filed seeking to declare the action of the respondent in forcibly acquiring the petitioners' house bearing No.2-3, Old No.1-69/ 2, admeasuring 540 square yards situated at Gachibowli, Serilingampalli Mandal, Ranga Reddy District for the purpose of Outer Ring Road Project without following due process of law as highly illegal, arbitrary and violative of Article 300-A of the Constitution of India.

Heard the learned counsel for the petitioners and Ms.B.Madhavi, learned Standing counsel for HMDA and perused the record.

In the counter-affidavit filed by the respondent, it was categorically stated that neither Special Deputy Collector (LA) himself nor any staff member of the Special Deputy Collector has ever gone to the petitioners' house on 02-03-2007 or 05-032007 or any other date for demolition and even as per the notification the names of the petitioners are not found place for the purpose of acquiring the subject property. In view of the same, this writ petition is misconceived and is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
