This writ petition is filed challenging the memo No.9834/VC/1/2008 HM & FW (VC) Department, dated 04-02-2017 issued by the 1st respondent and showcause notice dated 13-07-2017 issued by the 2nd respondent, wherein to recover the amounts alleged to be misappropriated in respect of Family Planning Operations conducted during the years 2002 to 2007 after lapse of more than eleven years of retirement of the petitioners without conducting enquiry in accordance with rule.

Learned counsel for the petitioners submits that without any basis, impugned show-cause notice was issued that too pertaining to the year 2006, when petitioners retired from services in the year 2006 and 2005 respectively. Heard learned Assistant Government Pleader for Services.

It is not the case of initiation of disciplinary proceedings, it is only the case of recovering the amounts. Moreover, this Court will not interfere at the stage of show-cause notice and it is not the case of the petitioners that it is without jurisdiction. In view of the same, this Court is not inclined to entertain the writ petition.

Accordingly the writ petition is dismissed. However, it is open for the petitioners to submit explanation to the impugned show-cause notice by raising all the objections. If

the petitioners require any documents, they can request for the same.
