The petitioner filed the present Writ Petition seeking a Writ of Mandamus to declare the action of the respondents in not awarding 5 marks as service weightage as per supplementary notification issued by the respondents tn supplementary Notification No.01/CGM(HR)2011, dated l7.IO.20lI to the petitioner as illegal, irregular, arbitrary, irrational and against the principles of natural justice and as per Articles 14 and 2l of Constitution of India and direct the respondents to award 5 marks as service weightage to the petitioner as per the said Notification.

On 30.03.2022, 72.07.2022, 0t.O8.2022, 02.08.2022 and there is no representation on behalf of the counsel for the petitioner on all the said dates. The matter is listed on 03.08.2022 under the caption "for dismissal". There is no representation on 03.08.2022 as well. On 04.08.2022 though l \ the matter is called in the morning session and also in the afternoon session, after being passed over, there is however, no representation on behalf of the counsel for the petitioner. The counsel for the respondents is present

Smt. A. Deepthi, learned counsel for the respondents draws the attention of this Court to Para No.18 of the counter affidavit filed by respondents 1 to 4 and contends that the total marks secured by the petitioner are 61.51 and even assuming without admitting by the relief prayed for by the petitioner is granted, yet the petitioner would not be qualified in view of the fact that cut off marks for non-local candidates are 78.79. The cut off marks for local candidates are 71.29 and the learned counsel for the respondents further seeks a direction for dismissal oF the writ petition on the said ground. 4.

Bringing the said fact on record that the petitioner secured less marks than the cut off marks, the writ petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
