THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY A.S.M.P.No.794 of 2016 in A.S No.768 of 2009 AND A.S.No.768 of 2009 COMMON JUDGMENT:

A.S.M.P.No.794 of 2016 under Order XXIII Rule 3 of Code of Civil Procedure Code, 1908 is filed to record the terms of compromise entered into between the petitioners/appellants and respondent in the above appeal.

Both parties are present and they are identified by their respective counsel. At the intervention of elders, the parties to the appeal entered into compromise and the same is reduced into writing. The terms of compromise are read over and explained to them in Telugu and parties are admitted the terms of compromise as true. Memorandum of Compromise is also filed along with M.P.

Hence, I find that the compromise is voluntary and it is in the interest of both parties, it is a fit case to record the compromise by exercising the power under Order XXIII Rule 3 of C.P.C.

Accordingly, A.S.M.P.No.794 of 2016 and the main appeal are allowed in terms of compromise. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this appeal shall stand closed. __________________________________ M.SATYANARAYANA MURTHY, J APRIL 21, 2016 Note:
