THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7198 OF 2016 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.40 seeking bail in crime No.45 of 2015 on the file of the Madanpalli Taluk Police Station, Chittoor District, registered for the offences under Sections 353, 307, 109 and 379 IPC, Section 20(1)(c)(III)(IV)(X) of A.P.Forest Act, Section 3 of the Red Sandal Wood and Red Sandal Transits Act, Rule 3 of the A.P.Red Sanders Wood Possession Rules and Section 30 of the Indian Arms Act.

Heard and perused.

Originally the petitioner was granted bail on 10.03.2015 and that the petitioner was directed before the Taluk Police Station concerned till filing of charge sheet. Later, the petitioner did not attend before the Court concerned ever after issuance of summons and as such, Non Bailable Warrants are issued against the petitioner. Pending the execution of NBWs, the petitioner was arrested in another crime and produced by PT warrant. Admittedly, he committed the crime while he was on bail and that the petitioner was also detained by the authorities concerned. Hence, this Court is not inclined to grant bail to the petitioner herein.

The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 20.06.2016 pln
