This writ petition is filed seeking to declare the action of the respondents in seizing the auto bearing registration No.AP 02 TC 8635 of the first petitioner and Tem.Reg. Vehicle No.AP 02 UXTR 9730 belonging to the petitioners, as illegal and arbitrary. The case of the petitioners is that auto bearing registration No.AP 02 TC 8635 of the first petitioner and Tem.Reg. Vehicle No.AP 02 UXTR 9730 belonging to the petitioners were seized on 13.03.2017, on the ground of violation of the provisions of the Essential Commodities Act, 1955 (for short, 'the Act') and questioning the same, the present writ petition is filed. Heard Smt.D.S.Lakshmi, counsel for the petitioners and the Assistant Governmnet Pleader (Civil Supplies). Learned counsel submits that in similar circumstances, the Writ Petition has been disposed of and one of the orders is W.P.No.1567 of 2017 dated 18th January, 2017. No useful purpose will be served in keeping the vehicles idle pending enquiry under Section 6-A of the Act and the same will get spoiled.
In view of the same, respondent No.2 is directed to release the auto bearing registration No.AP 02 TC 8635 of the first petitioner and Tem.Reg. Vehicle No.AP 02 UXTR 9730 belonging to the
petitioners, pending enquiry under Section 6-A of the Act, on furnishing security to his satisfaction within a period of two weeks from today.
With the above direction, the writ petition is disposed of. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs. ________________ JUSTICE S.V.BHATT Dated 7-4-2017.
