HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10346 OF 2015 O R D E R :

This writ petition is filed seeking Writ of Mandamus declaring the action of the respondents 2 and 4 in proposing and proceeding for demolition of the properties bearing D.Nos.from 10-1-18 to 57 situated at Mydukuru Main Road, Badvel Municipality and Mandal, YSR District, in respect of petitioners No.1 to 16 and property bearing D.No.4-1-1 and D.No.4-1-1089 to 4-1-1089/6 in respect of petitioners 17 and 18 situated at Siddavatam Road-Nellore main Raod, Gopavaram Mandal, Badvel Municipality, YSR District, as arbitrary, illegal and in violation of Article 300-A of Constitution of India. The case of the petitioners is that they are owners and possessors of the properties in question situated at Mydukuru Main Raod, Badvel Municipality, YSR District.

While so, the respondents 2 to 4 are trying to demolish their properties without following due process of law and also in violation of Article 300-A of Constitution of India. It is also stated that they have made markings in their properties cautioning the petitioners that they are going to demolish the said properties for laying of the pipe line. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioners. Sri Md.Saleem, learned Standing counsel appearing for the 2nd respondent submits that respondent authorities would follow due process before affecting the demolition of the petitioners' properties. In view of the aforesaid submission, the writ petition is disposed of directing the respondents 2 and 4 not to demolish the properties of the petitioners without following due process of law. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed. ____________________________
