ORAL ORDER:

Petitioner is aggrieved by inclusion of property to an extent of Ac.1.45 cents in Survey No. 154/5 Gundlapalem village, Nellore Rural Mandal, SPSR Nellore district in the list of prohibited properties under Section 22-A of Indian Registration Act, 1908 (for short the Act, 1908) treating it as Government land.

Heard learned counsel for petitioner and learned Government Pleader for Revenue and with their consent the writ petition is disposed of at admission stage.

As held by the Full Bench of this Court in Vinjamuri Rajagopala Chary v. State of Andhra Pradesh1, if a person is aggrieved by inclusion of his property in prohibited list under Section 22-A of the Act, 1908, he has to file an application before the competent authority, in the instant case the District Collector, to delete the property claimed to have been owned by the petitioners from the list of prohibited properties. Admittedly, no such application is filed by petitioner. 4.

Thus, petitioner is granted liberty to make appropriate application to the District Collector for deletion of the property claimed by him as owned from the list of prohibited properties. If such an application is filed, the District Collector shall consider and pass appropriate orders as warranted by law within a period of six weeks from the date of receipt of such application by assigning due reasons in support of his decision.

Accordingly, the writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
