THE HONOURABLE SMT JUSTICE JUVVADI SRIDEVI CRIMINAL PETITION NO. 3954 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners/Accused Nos.2 to 5 in the event of their arrest in connection with Crime No.75 of 2022 on the file of Station House Officer, Karimnagar II-Town Police Station, Karimnagar District registered for the offences punishable under Sections 366-A, 354-D, 354, 343, 506 read with Section 34 of Indian Penal Code (IPC) and Section 11 read with Section 12 and 17 of POCSO Act. 2.

Heard the learned counsel for the petitioners/Accused Nos.2 to 5 and the learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

Learned counsel for the petitioners contended that there are no allegations against the petitioners and they are no way concerned and never involved in any crime. The allegation is that there was a love affair between the Accused No.1 and the daughter of the de facto complainant. Accused Nos.2 and 3 are the brother and sister-in-law of Accused No.1 and they are no way concerned with

the said love affair. It is alleged that Accused No.1 had taken the daughter of de facto complainant to Karimnagar, and Accused Nos.2 and 3 joined them and they all went to the house of Accused No.4 and stayed there for one day. The only allegation against Accused No.5 is that the daughter of de facto complainant and Accused No.1 took shelter in the house of Accused No.5 at Hyderabad. Learned counsel for the petitioners further contended that the petitioners are ready to co-operate with the investigation as and when required.

Learned Assistant Public Prosecutor submits that eleven witnesses were examined and almost the investigation has been completed and the charge sheet is yet to be filed. 5.

Having regard to the above submissions, this Court is inclined to grant Anticipatory Bail to the petitioners/Accused Nos.2 to 5. 6.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.2 to 5 shall be enlarged on bail subject to the following conditions:

i) The petitioners/Accused Nos.2 to 5 are directed to surrender before the Station House Officer, Karimnagar II Town Police Station,

Karimnagar District, within a period of ten (10) days from today and on such surrender, the petitioners/Accused Nos.2 to 5 shall be enlarged on bail on their executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties to the like sum each to the satisfaction of Station House Officer, Karimnagar II Town Police Station, Karimnagar.

The petitioners/Accused Nos.2 to 5 shall cooperate with the investigating officer as and when required.

ii) The petitioners/Accused Nos.2 to 5 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
