Mr. Kunapureddy Sai Babuji, v. The Union Govt Of India,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20314 OF 2016 ORDER:
The case of the petitioner is that he made an application before the passport authorities and obtained Indian Passport vide PP.No.Q195140 dated 26.06.1980 and the said passport was valid till 25.06.1985. Thereafter petitioner made an application for renewal of the same. But the respondent authorities kept the application of the petitioner pending stating the surname written in the old passport does not match with the records furnished by him in the new application. With regard to the same, the petitioner made an application dated 12.05.2016 along with documentary proof for correction of surname from Kunapa to Kunapureddy. Since no action has been initiated so far in respect of the application made by the petitioner on 12.05.2016, the present writ petition is filed. Heard the learned counsel for the petitioner.
Learned Standing counsel for respondents produced written instructions stating that the petitioner has not approached the authorities and due to efflux of time, the records pertaining to the petitioner's passport bearing No.Q195140 issued in the year 1980 are not available in the office. He further submits that as per the existing provisions, for correction of surname/name, the applicant had to insert advertisements in two reputed newspapers (one in local newspaper of the area in which he is residing and the other in the newspaper of the area of permanent address) and submit the original newspapers along with sworn affidavit AnnexureE. In view of the same, it is for the petitioner to make necessary application by following the procedure as stated above by the learned Standing counsel.
On such application being made by the petitioner by following the procedure, the respondent authorities shall pass necessary orders in accordance with law. With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
