THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35247 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in interfering in the day-to-day affairs of the petitioner company on the premise of F.I.R.No.135 of 2016 without investigating and without authority, as illegal, void and arbitrary and consequently direct the respondents not to interfere with the day-to-day banking activities of the petitioner company.

Heard and perused the material.

Learned counsel for the petitioner submits that the third respondent, in the guise of investigation in crime No.135 of 2016, is interfering with the day-to-day affairs of the company without following due process of law. He further submits that the petitioner is ready to cooperate with the investigation if the respondents follow the due process of law.

Considering the facts and circumstances of the case, the third respondent is directed to complete the investigation without harassing the employees of the petitioner company and also without interfering with the day-to-day affairs of the petitioner company, and file final report, if any, in accordance with law. The petitioner is also directed to cooperate with the investigating agency. The writ petition is accordingly disposed of.
