Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent Nos.2 and 3 in calling the petitioner and his family members to the police station, harassing and detaining them hours together, at the instance of respondent No.4, as illegal and arbitrary.

It is the case of the petitioner that the respondent police are calling them to the police station and harassing him, without there being any crime registered against them.

Learned Government Pleader for Home, on instructions, submits that the allegations made in the writ affidavit are false. 5.

As seen from the record, there is no concrete material to show that the petitioner was illegally detained in the police station. But, having regard to the rival submissions made, the respondent police are directed not to summon and detain the petitioner and his family members, except following the procedure contemplated under law. If the respondent police intend to take any action against the petitioner, the same shall be in accordance with law. No costs.

CPK, J W.P.No.23307 of 2017 As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
