Mulakalapalli Padma v. Mulakalapalli Subrahmanyeswara Rao
THE HON'BLE SRI JUSTICE G.CHANDRAIAH C.R.P.NO.1991 OF 2016
O R D E R
Heard the counsel for the petitioner at the stage of admission.
2. The petitioner is the wife and the respondent is her husband. The respondent filed HMOP.No.150 of 2012 on the file of Principal Senior Civil Judge at Machilipatnam under Section 13(1)(ia) (ib) of Hindu Marriage Act against the petitioner herein for grant of divorce and when the case is at the stage of arguments, he filed I.A.nos.75 and 76 of 2016 in HMOP.No.150 of 2012 to reopen the petition which was posted for arguments and to permit him to amend the date of marriage as 7.6.1985 instead of 5.6.1985. By order dated 9.2.2016, the trial court allowed both the I.As. and aggrieved by the order and decree passed in I.A.No.76 of 2016, the petitioner - wife, filed the present revision.
3. From the material on record, it could be seen that as the parties were not mislead by wrong mention of date and as no prejudice would be caused to the petitioner by allowing the present amendment, which avoids multiplicity of proceedings, the trial court allowed amendment on costs. I do not find any merit in the revision and the same is dismissed at the stage of admission. No costs.
4. Miscellaneous petitions pending if any, shall stand closed. AVS ------------------------------------ 21-04-2016
