HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 407 OF 2016 02-06-2016 Between:

Penmetsa Venkata Siva Prasada Murthy Raju and another ... Appellants And Dr. Indukuri Ramakrishna Gandhi and others ... Respondents

HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 407 OF 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

The order impugned in the instant appeal is dated 20-10-2014. By this order, the statement of learned Standing Counsel for Municipality was recorded. He had assured the Court that necessary action will be taken within a period of six weeks from the date of receipt of a copy of the order in respect of the construction made in the parking area. Accordingly, action was initiated by issuing a show cause notice.

Learned counsel for the appellants submits that the appellants have challenged the said notice in a suit and obtained interim order therein.

In view thereof, this appeal, in our opinion, has rendered infructuous and dismissed as such.

Miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B. BHOSALE, ACJ ________________________ P. NAVEEN RAO, J 02-06-2016 ks
