THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15453 of 2019 ORDER:

With the consent of both the parties, this writ petition is disposed of at the admission stage.

This Writ Petition is filed for the following relief: ".........Writ of Mandamus declaring the action of the 2nd respondent in not passing the final orders on the suspension order of the petitioner vide Proceedings in Rc.No.P5/349/2017 dated 04.06.2018 after lapse of one year as the same is illegal, arbitrary and violative of principles of natural justice and consequently direct the 2nd respondent to pass orders on the suspension proceedings dated 4.6.2018 in Rc.No.P5/349/2017 in accordance with law and to pass such other................" Heard Sri S.Pradeep Kumar, learned counsel for the petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that he is presently working as Panchayat Secretary, Grampanchayat Penuballi, Penuballi Mandal, Khammam District.

While so, the petitioner was placed under suspension vide proceedings dated 04.06.2018 basing on the report of the 4th respondent. The grievance of the petitioner is that though more than one year has elapsed, the respondents are not reviewing the suspension order in accordance with the Rules.

Learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the

respondents to review the suspension order dated 04.06.2018 strictly in accordance with G.O.Ms.No.86 dated 08.03.1994. Learned Government Pleader appearing for the respondents contends that the suspension orders initiated against he petitioner would be reviewed in terms of G.O.Ms.No.86 dated 08.03.1994 and appropriate orders would be passed in accordance with law.

Having regard to the rival submissions made by the parties, this Court is of the considered view that this Writ Petition can be disposed of directing the respondents to review the suspension order of the petitioner strictly in terms of G.O.Ms.No.86 dated 08.03.1994 and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

With these observations, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
