THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.13100 OF 2018 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 4th and 5th Respondents in harassing the petitioner by calling him to the Police Station and forcing to take photographs for the purpose of opening rowdysheet and to declare the same as illegal, arbitrary and violative of fundamental rights guaranteed under Constitution of India, in the interest of justice."

At the hearing, learned Government Pleader for Home (A.P.), appearing for the respondents, on written instructions, dated 25.04.2018, a copy of which is placed on record, having submitted the details of the crimes registered against the petitioner, which are mentioned in the said written instructions, laid emphasis on the conduct and character of the petitioner and the necessity for opening of a rowdy sheet and finally, submitted that a rowdy sheet has already been opened. He also placed on record, the proceedings, dated 14.02.2018, of the Sub-Divisional Police Officer, Kadiri Sub-Division, in support of his submissions. 3.
In that view of the matter, learned counsel for the petitioner fairly submitted that the petitioner is now required to take appropriate proceedings to challenge the rowdy sheet said to have been opened against him and sought permission to withdraw the writ petition without prejudice to the rights and contention of the
petitioner and requested to reserve liberty to file an appropriate writ petition/proceedings, which the law permits. 4.
Having regard to the submissions, the Writ Petition is dismissed as withdrawn, however, without prejudice to the rights and contentions of the petitioner and reserving liberty as sought for. There shall be no order as to costs.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
