Heard counsel for the petitioner and the Government Pleader for Excise appearing for respondents. 2.

Petitioner had executed a bond for a sum of Rs.1,00,000/- on 04.01.2018 in COR No.243/2017 and COR No.265/2017 and the same is now sought to be forfeited on the ground that petitioner is alleged to have committed an offence as per report of the Station House Officer, Prohibition & Excise, Kothakota.

Mere arraignment in an offence cannot be taken to be a conviction whereby it could be said that the petitioner had committed a breach of the bond furnished by him for maintaining good behaviour.

Therefore, The Writ Petition is allowed and the impugned notice dt.10.01.2018 in MC.No.E/23/18 is set aside. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
