THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15451 of 2019 ORDER:
This writ petition is filed complaining inaction on the part of the sixth respondent - Panchayat Secretary, Chilkuru Mandal, Suryapet District, in considering application dated 11.03.2019 submitted by petitioner for mutating her name in the Gram Panchayat records.
It is the case of the petitioner that herself and her husband were residing in house bearing No.1-168/4 situated at Chilkur Village and Mandal, Nalgonda District, and her husband passed away on 03.07.2018, as such, she along with her children is residing in it. She asserts that an application was filed by her before the sixth respondent on 11.03.2019 for mutation of her name in the Gram Panchayat records with respect to the aforesaid house property. She complains that the said application is not being processed by the respondent authorities. Learned Standing Counsel submits, on instructions, that no such application was received by the Gram Panchayat, however, the sixth respondent would process the application dated 11.03.2019, enclosed to the writ petition, in accordance with law, by treating it as the one already submitted by the petitioner to the Gram Panchayat.
CKR, J W.P.No.15451 of 2019 Having regard to the respective submissions, the writ petition is disposed of with the direction to the sixth respondent to treat the application dated 11.03.2019, enclosed to the writ petition, as the one already submitted by the petitioner to the Gram Panchayat, and process the same and take necessary action in accordance with law. It is needless to mention that the sixth respondent may seek further information if required from the petitioner and the petitioner shall also furnish the same. This entire process shall be completed within a period of eight (8) weeks from today.
Miscellaneous applications, if any pending, shall also stand disposed of.
