THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI A.S. No.1049 of 1997 JUDGMENT:

Learned counsel for the appellants would submit that despite the information furnished to the appellants to come and instruct him for proceeding in the appeal suit, they did not show any interest probably because of some settlement outside the Court. He would further submit that in view of the fact that the appellants are not showing any interest in the matter, the appeal suit may be dismissed for nonprosecution. However, learned counsel appearing for the contesting respondents would submit that as per the instructions received by him, there is no settlement outside the Court; but, the said respondents have no objection for dismissal of the appeal suit for non-prosecution.

Recording the submissions, the Appeal Suit is dismissed for non-prosecution. No order as to costs. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
