THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.13056 and 18295 of 2018 COMMON ORDER:

There are 278 petitioners and they are questioning the alleged action on the part of the respondents in taking steps to demolish the dwelling units i.e., houses and huts of the petitioners in Sy.Nos.297/1, 297/2/1, 297/3/1, 298/1, 294/1 corresponding to T.S.No.17, Block N, Ward 21, Vivekananda Nagar of Bhojagutta locality, Gudimalkapur village, Asifnagar Mandal. 2.

An Affidavit deposed by the Tahsildar, Asifnagar Tahsil, Hyderabad, is filed stating that 270 petitioners, out of 278 petitioners, have been found eligible and they will be allotted two bed room houses in the ensuing constructions. The affidavit also states that there are eight individuals who are found ineligible. The particulars of the same, as indicted in the said affidavit, are as follows:- Sl.

An affidavit deposed by 167th petitioner namely P.Uma, W/o.P.Ravi is filed stating that the remaining eight people are also entitled for allotment of two bed room houses and the conclusion arrived at by the Tahsildar is incorrect and they have documentary evidence to show their eligibility.

Today, the proceeding bearing No.197/EEI(H)/2BHK/GHMC/2017-18, dated 28.08.2018, of the Commissioner, GHMC, are placed on record by the learned Government Pleader, wherein temporary allotment for transit accommodation for 270 people, who are found eligible, is shown at Ameenpur.

In view of the said developments in these matters and keeping it open for the petitioners, who are found ineligible by Tahsildar after enquiry, to approach the Revenue Divisional Officer with necessary documents in support of their claim, the Writ Petitions stand disposed of. It is also made clear that if the petitioners, who are found ineligible, make any such applications, the same be enquired into and orders be passed, as per law.

The petitioners, who are found eligible, are granted time till 15.09.2018 to go to the transit houses provided by the respondents herein.

Accordingly, the Writ Petitions are disposed of. There shall be no order as to costs.
