THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE NO.480 OF 2014 ORDER:

Neither is the learned counsel for the petitioner present nor is there any representation on his behalf.

The order, violation of which is alleged in the present Contempt Case, is the order passed in WP.No.3083 of 2013 dated 11.02.2013 wherein the submission of the learned Government Pleader was recorded that, after completion of investigation, an appropriate report would be filed before the Court concerned within a period of four weeks. The four week period expired on 12.03.2014.

In the counter affidavit filed on behalf of the Inspector of Police, Piduguralla Rural Circle, Guntur District it is stated that, a final report was filed under Section 173(2) of the Code of Criminal Procedure before the I Additional Junior Civil Judge, Narasaraopet on 17.10.2014.

In the light of the averment in the counter affidavit, it is evident that the order of this Court has been complied with albeit belatedly. The petitioner has tendered his unconditional apology for the belated compliance. I see no reason, therefore, to proceed against the respondent under the Contempt of Courts Act, 1971.
