HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27012 of 2007 ORDER :

This writ petition is filed seeking a writ of Mandamus, declaring the action of respondents in not promoting the petitioner as Electrician (DC) on par with his junior, as illegal and arbitrary and set aside the same and further direct the respondents to promote the petitioner as Electrician (DC) on par with his junior Sri Ramesh with all consequential benefits including pay fixation and arrears.

Heard Sri P.Govinda Rajulu, learned counsel for the petitioner and Sri A.Ravi Babu, learned Standing Counsel for respondents. It has been contended by the petitioner that he was initially appointed as a Hammer Man and later promoted as Shramik. The petitioner further submits that he was fully eligible and qualified for the post of Electrician (DC). The grievance of the petitioner is that his junior was promoted as Electrician (DC), ignoring his case. Challenging the same, the present writ petition is filed.

Learned counsel for petitioner submits that the action of respondents in considering the case of junior to the petitioner by ignoring the case of the petitioner for promotion as Electrician (DC), is illegal and arbitrary. He seeks direction to the respondents to consider the case of the petitioner for promotion to the post of Electrician (DC). Learned Standing Counsel for respondents submits that the case of the petitioner would be considered in accordance with his seniority and merit.

AKS, J W.P.No.27012 of 2007 Having considered the rival submissions of the parties, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for promotion to the post of Electrician (DC) in accordance with Rules and pass appropriate orders within four weeks from the date of receipt of a copy of this order.

With these observations, the writ petition is disposed of. No order as to costs.
