Smt.B.Bhagya Lakshmi v. The State Of Telangana,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10627 of 2016 ORDER:
Heard Sri K.V.L. Narasimha Rao, learned counsel for the petitioner, and Sri Sampath Prabhakar Reddy, learned Standing Counsel for the Greater Hyderabad Municipal Corporation. Both the learned counsel are in agreement that this case is squarely covered by the decision rendered by this Court in W.P.No.12861 of 2007. A copy of the order dated 16.11.2007 passed in the afore-stated writ petition is placed on record. For reasons alike as were stated in the afore-stated order and in terms thereof, the writ petition is disposed of directing the respondents to reconsider the application of the petitioner for granting building permission in accordance with law and without reference to the pending LGC No.29 of 2006. However, in the event the LGC case, which is pending before the Special Court, is decided against the petitioner, she shall not claim equities or compensation for the cost of the building constructed by her.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR Date:31.03.2016 IBL
