HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.137 of 2016 ORDER:

This petition is filed to withdraw O.P.No.164 of 2015 from Principal Senior Civil Judge, Kovvur, West Godavari District, and transfer the same to Family Court, East Godavari at Rajhmundry.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 18.04.2009 a t Dwaraka Tirumala Temple as per Hindu rites and custom and she joined respondent at his house at Prakkilanka Village. She stated that respondent and his parents looked after well for some time, thereafter they started ill-treating her and finally respondent left her at her parents house and went away and the efforts made by her parents and elders to compromise the matter to lead matrimonial life have failed and she came to know that respondent is living with another woman and having no option she went to her parents house. She further stated that as respondent filed O.P.No.164 of 2015 before Principal Senior Civil Judge, Kovvur, West Godavari District, for divorce and in pursuance of summons received, she attended the Court on 29.01.2016 and when she came out of the Court, respondent threatened her to kill if she do not agree for divorce and due to fear she went away and later approached local police, but they

refused to receive the complaint and that she sent the complaint to Superintendent of Police through registered post with acknowledgment due. She stated that as she is apprehending danger to attend the hearing of the case at Kovvur due to the threatening from respondent, she sought for transfer of O.P.No.164 of 2015 from Principal Senior Civil Judge, Kovvur, West Godavari District to Family Court, East Godavari at Rajahmundry.

This Court permitted petitioner to take personal notice through registered post with acknowledgment due both to respondent and also to his advocate on record in the lower Court and in compliance of the said order, notice was sent and as per the postal track report, notice sent through advocate on record was delivered on 31.03.2016. In spite of service of notice respondent neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit filed in support of petition, O.P.No.164 of 2015 is withdrawn from Principal Senior Civil Judge, Kovvur, West Godavari District, and transferred to Family Court, East Godavari at Rajhmundry, for disposal in accordance with law.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
