Kotha Kota Narsimha Reddy v. The Assistant Vehicles Inspector,
W.P.No.21605 of 2015 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
"To issue an appropriate writ, particularly one in the nature of Mandamus or any other appropriate writ declaring that the action of respondent No.1 in seizure of the Tipper (Ashok Leyland) vehicle bearing No. AP 13 X 3363 on 22.07.2014 and not passing any orders against my representation dt. 01.12.2014 made to the 2nd respondent herein as illegal, arbitrary, against the principles of natural justice and violating of Article 14, 21 of the Constitution of India".
2. Heard Sri Ch.Anjaneyulu, learned counsel for the petitioner and the learned Government Pleader for Transport, apart from perusing the material available on record.
3. According to the petitioner, he is the owner of Tipper (Ashok Leyland) vehicle bearing Reg.No.AP13X 3363. The Assistant Motor Vehicles Inspector-1st respondent seized the said vehicle vide vehicle check report dated 22.7.2014, while pointing the following irregularities.
1. Registration Certificate not produced.
2. Fitness Certificate
3. Permit
4. Insurance Certificate
5. Driving Licence not produced.
6. P.V.C.
7. Chased and caught with a distance of 5 k.m. towards Bolaram village.
8. No proof of tax.
4. In the present Writ Petition, the grievance of the petitioner is that he made a representation on 1.12.2014 to the Regional Transport Authority, Medak district-2nd respondent herein, requesting for release of the vehicle, but no orders have been passed so far on the said
application.

Taking into consideration the totality of the circumstances and the nature of controversy, this Court is of the view that ends of justice would be met if a direction is issued to the respondents for passing appropriate orders on the application made by the petitioner on 1.12.2014 by fixing some time.

For the foregoing reasons, the writ petition is disposed of, directing the 2nd respondent herein to pass appropriate orders on the representation dated 1.12.2014 said to have been made by the petitioner herein, within a period of one month from the date of receipt of a copy of this order by giving notice and opportunity. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
