O R D E R

The case of the petitioner is that based on his complaint, the 3rd respondent - Station House Officer, Munagala Police Station, Munagala, Suryapet District, registered case in Cr.No.91 of 2019 against private respondents 4 to 6, for the offences punishable under Sections 406 and 420 of IPC. Now the grievance of the petitioner is that the 3rd respondent is not conducting investigating in the said crime.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Munagala Police Station, Suryapet District dated 01.08.2019, wherein it is stated as under: "On receipt of above complaint, a case was registered in Crime No.91 of 2019 U/s 406 and 420 IPC of Munagala Police Station on 22.05.2019. It is submitted that during the course of investigation L.Ws.1 to 3 were examined and their statements were recorded, the investigating officer addressed a letter to the Bank Manager, HDFC Bank, Suryapet on 28.06.2019 to furnish the account details of Venkanna vide account No.3440102000001021 and whether amount has been transferred from the said account. The reply of the bank authorities is awaited.

After obtaining reply from the bank authorities, investigation will be proceeded further. It is submitted that Bheemaboina Mallesh has exchanged the new tractor with his old tractor with Ram Reddy and Ram, who are respondents 5 and 6. It is submitted that at present, the tractor bearing No.TS 05 EK 6614 is in the custody of respondents 5 and 6.

It is submitted that the case will be finalized within a period of four weeks and a final report will be filed before concerned court." Recording the above statement made in the written instructions, writ petition is disposed of directing the 3rd respondent to complete investigation and file report in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

Interlocutory applications pending, if any, shall stand closed. No order as to costs.
