HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 4632 of 2011 ORDER:

Heard learned counsel for the petitioners, Government Pleader for Revenue and learned counsel for respondent Nos.5 to 8. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondents in taking action for correction of wrong entries in revenue records in respect of land admeasuring Ac.12.25 gts., in Sy.Nos. 128 and 134 of Gorrekunta village, Geesugonda Mandal, Warangal District, by conducting enquiry in the light of representation dated 14.02.2011, as illegal, arbitrary and violative of the principles of natural justice; and consequently direct the respondents to effect changes in the revenue records in respect of the above said land. At the time when the matter is taken up for hearing, it is brought to the notice of this Court that the first petitioner herein filed O.S.No.

73 of 2011 on the file of the II Additional District Judge, Warangal, against respondent No.8 herein and others, for partition, separate possession and rectification of entries apart from other reliefs. Since the issue with regard to share of the property is in dispute before the civil Court, the question of correction of the wrong entries in the revenue records in respect of the land admeasuring Ac.12.25 gts., in Sy.Nos. 128 and 134 of Gorrekunta (V), Geesugonda (M), Warangal District, may not be possible.

Leaving it open to the petitioners to raise all the objections before the civil Court, the writ petition is disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
