HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.16396 OF 2015 ORDER:
This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of the respondents in not sending any appointment order/letter appointing the petitioner as conductor on contract basis in pursuance of the contract conductors panel as illegal, arbitrary and in violation of principles of natural justice and to set aside the same and to direct the respondents to appoint the petitioner as conductor on contract basis with all consequential benefits.
2. Heard the leaned counsel appearing for the petitioner and the learned standing counsel appearing for the respondents/Corporation.
3. It is submitted by the petitioner that the first respondent issued notification in the year 2011-2012 calling for applications from the candidates for the post of conductors on contract basis in the third respondent region. The petitioner applied for the said post and was selected by the selection committee. He was also directed to undergo training. It is submitted by the petitioner that his name is shown at Sl.No.34 in the selection list.
4. The grievance of the petitioner is that though some of the juniors were issued posting orders, the petitioner was not issued any posting orders. Therefore, he submitted a representation, dated 05.02.2014 to the third respondent to consider his case for appointment as conductor and the same is pending with the third respondent.
5. Under the aforesaid circumstances, the writ petition is disposed of directing the third respondent to dispose of the representation, dated 05.02.2014 submitted by the petitioner and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this writ petition shall stand closed. _________________ R.KANTHA RAO, J Date:15.06.2015 ccm
