THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.2493 of 2018 ORDER:

Heard Sri Tera Rajinikanth Reddy, learned counsel for the revision petitioner.

Virtually, there is no order as such to find out material irregularity or illegality committed by the Court below, but what all the learned counsel would submit is that the Court below, despite filing written arguments, is not disposing of the suit in O.S.No.652 of 2015. That has been the anxiety of the petitioner herein.

Learned counsel has also drawn the attention of this Court to certain docket orders, last of which is dated 20.02.2018. On 20.02.2018, the Court below, in fact, posted the case to 20.06.2018 for further hearing, which according to the learned counsel is unnecessary, as comprehensive written arguments were already submitted. In fact, in such a situation, the petitioner ought to have sought for advancement of hearing of the suit by filing an independent application narrating the urgency. Even otherwise, the Court below is also obligated with the duty to hear the arguments of the petitioner, in case it is not satisfied with the written arguments filed by the petitioner. However, the Court below is directed to take up hearing on 20.06.2018 and dispose of the suit in accordance with law. Subject to the above observations and directions, the Civil Revision Petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any, pending in the present revision, stand closed.
