HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P. NAVEEN RAO Writ Appeal No.5 of 2016 PC:(Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Learned counsel for the parties, in view of peculiar facts and circumstances of the case and to put an end to the dispute, have agreed for the following order:

"1. The order of reinstatement passed by learned Single Judge dated 1.11.2013 is confirmed.

2. Insofar as the full pay and salary for the period that the 1st respondent was kept out of service is concerned, the appellant have agreed to pay the same from the date of the order of the learned Single Judge, i.e., 1.11.2013, equal to the salary, which the 1st respondent's batch mates are getting as on that date. In view thereof, it is needless to mention that they shall pay the difference of the regular salary paid in pursuance of the interim order and the salary the 1st respondent is entitled to, within a period of eight weeks from today. It is needless to mention that the 1st respondent is entitled for all other consequential benefits, including regularisation of his service under the Rules of 2009. The part of the operative portion, whereby, the appellant are directed to pay costs is set aside.

3. Since we have passed this order by consent, in view of the peculiar facts and circumstances of the case, we keep all contentions of the appellant open to be raised, if circumstances so demand or in case if any other employee/workman seeks similar relief."

The writ appeal is accordingly disposed of.

Consequently, pending miscellaneous petitions shall also stand closed.
