O R D E R

The prayer of the petitioner in this case reads as under: 'This Hon'ble court may be pleased to issue writ or direction preferably Writ of Mandamus declaring the action of the respondent no.4 in taking steps to make constructions on the road and also adjacent to pochamma canal situated in Sy. No.585 at B.C. colony, Yellareddy(V&M) Kamareddy District is illegal, arbitrary and violative of principles of natural justice and consequently direct the respondent nos. 2 to 5 and their staff not to make any constructions on the subject road and pass such other or further orders as this Hon'ble court deems fit and proper in the circumstances of the case'.

Sri Balu Mahendra, learned counsel representing Sri Kowturu Pavan Kumar, learned counsel for the petitioner, would however inform this Court that respondent No.4 is not taking any steps to make construction on the road at present and therefore, the cause in this writ petition does not survive for consideration on merits at this stage. He states that the petitioner is not interested in pursuing the present writ petition owing to the aforestated circumstance but liberty may be reserved to the petitioner to file a fresh case if and when a cause of action arises. The writ petition is accordingly dismissed as not pressed reserving liberty to the petitioner as aforestated. Pending miscellaneous petitions shall also stand dismissed.
