THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.4646 of 2015 ORDER:
The petitioner in O.P. No.3 of 2014 on the file of the Court of the learned Senior Civil Judge-cum-Election Tribunal under the A.P. Panchayat Raj Act, Mahabubnagar, is the petitioner herein. The said O.P. was filed, under Section 233 of the A.P. Panchayat Raj Act (for short, 'the Act') challenging the election of first respondent, in June 2014 and it was adjourned from time-to-time from September 2014 to June 2015 for filing of counter and it is being adjourned for enquiry. The petitioner has also filed an affidavit in lieu of chief examination as PW1 in June 2014 itself. When the O.P. is not being taken up for disposal as expeditiously as possible and when the matter is being adjourned, challenging the inaction the present Civil Revision Petition was filed.
As the O.P. is directed against the declaration of result in favour of first respondent under the provisions of the Act, it is incumbent upon the Tribunal to take up the matter on priority basis and dispose of the same in accordance with law expeditiously.
In the above circumstances, the learned Senior Civil Judge-cum-Election Tribunal under the A.P. Panchayatraj Act, Mahabubnagar, is directed to take up O.P. No.3 of 2014, pending on its file, and dispose of the same on or before 31.08.2016. Accordingly, this Civil Revision Petition is disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
