THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22600 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to declare the action of 3rd respondent in not considering the petitioner's application for mutation of her name in the municipal records in respect of house bearing D.No.1-3-24, KNF Road, Amalapuram, East Godavari District, as illegal and arbitrary, and consequently, direct the 2nd respondent to conduct an enquiry regarding change of assessment of the petitioner's property.

Heard and perused the material available on record. It is the case of the petitioner that she is the owner and possessor of the abovementioned property and she got the same in her name through a registered sale deed, dated 19.03.2008, executed by her husband. The petitioner made an application to the 3rd respondent - Commissioner, Amapapuram Municipality, to mutate her name in the municipal records. But, no action has been taken by the 3rd respondent. The petitioner came to know that the assessment of her property has been changed in the name of one Guthula Srinivas, who is a real estate businessman, and therefore, the petitioner made an application on 15.12.2016 to the 2nd respondent - Director of Municipal Administration, Amaravathi, Krishna District, to order for an enquiry regarding the aspect of change of assessment by the authorities of Amalapuram Municipality.

But, no action has been taken by the 2nd respondent on the application of the petitioner. Hence, this writ petition.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

The Writ Petition is disposed of directing respondents 2 and 3 to consider the applications made by the petitioner and pass appropriate orders in accordance with law as expeditiously as possible. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
