THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15537 of 2019 ORDER:

With the consent of both the parties, this writ petition is disposed of at the admission stage.

This Writ Petition is filed for the following relief: ".........Writ of Mandamus declaring the action of the respondents in not releasing the 16 Annual Grade Increments and Revised Pay Scales 2005 & 2010 and Special Grade Increments even after conclusion of Disciplinary Proceedings and imposition of punishment as illegal, arbitrary, unjust, unreasonable and contrary to Art.14 of the Constitution of India and consequently direct the respondents to release 16 Annual Grade Increments and Revised Pay Scales 2005 & 2010 and Special Grade Increments to the petitioner immediately duly considering the representations of the petitioner dated 04.07.2019 and 11.07.2019 in the interest of justice and to pass such other........."

Heard Sri D.Ramakrishna, learned counsel for the petitioner and the learned Government Pleader for Services-II. It has been contended by the petitioner that initially he was appointed as Junior Stenographer in the 2nd respondent institution. While so, on certain allegations, he was placed under suspension and a Criminal Case in CC.No.1023/2008 was lodged against him. During the pendency of the said Criminal Case, the petitioner was reinstated into service w.e.f. 03.03.2009. Later, the VI Additional Chief Metropolitan Magistrate, Hyderabad vide its order dated 03.08.2010 acquitted the petitioner in the said CC. Though the petitioner

was reinstated into service and the Criminal Case registered against him was ended in acquittal, the respondents are not releasing 16 annual grade increments and revised pay scales of 2005 & 2010. With regard to the same, petitioner made representations on 04.07.2019 and 11.07.2019. But, so far the respondents have not passed any orders on the said representations.

Therefore, learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner and pass appropriate orders on the representations submitted by the petitioner on 04.07.2019 and 11.07.2019.

Learned Government Pleader appearing for respondents contends that the case of the petitioner would be considered and appropriate orders would be passed on the representations submitted by the petitioner.

Having regard to the rival submissions made by the parties, this Court is of the considered view that this Writ Petition can be disposed of directing the respondents to consider the case of the petitioner for grant of 16 annual grade increments and revised pay scales by passing appropriate orders on the representations submitted by the petitioner on 04.07.2019 and 11.07.2019 in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

With these observations, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
